Would this be a concern?

eBay, I'm sure, would take this down once someone files
a report with them. Still, I bet Price staffers (or lawyers)
would be interested in this one...

As far as I can tell, some combination of MGP and an entity called "Togo Music" currently hold the publishing rights to TPIR music, the former now being a division of Fremantle. So yeah, they might care.

BUT WAIT! Let's see now, if I go out and get a DVD of a Harry Potter movie, burn a bunch of dupes and sell them on ebay with the disclaimer that "You will be bidding on the cost of the DVD itself not the movie on it" despite the fact that I don't own the distribution rights, then I'm not breaking any copyright laws, now am I? Of course I'm not.

OK, class. What about the following sounds a bit fishy?

Oh really? Best case, a blank CD costs less than a dime when bought in bulk. This joker wants $7.95 if you buy it outright, and not much less if you place a bid.

This guy is seeing dollar signs, but not from my wallet. Scammer.

There's no music on this CD, you know. Just ones and zeroes. Everyone knows you can't copyright "zero" and "one".

That's as bad as patenting the emoticon. Oh, wait...
